A Study of the State of the Judiciary in the Kurdistan Region of Iraq

Abstract

This study examines the current state of the judiciary in the Kurdistan Region of Iraq through a critical analytical approach, assessing the extent to which the judicial system complies with internationally recognized standards of judicial independence, impartiality, competence, accountability, and access to justice. It analyzes the constitutional and legal framework governing the judiciary, institutional structures, and the practical challenges affecting judicial performance, including issues related to judicial independence, executive influence, transparency, and public confidence. The research further compares the existing legal and institutional framework with relevant international instruments, such as the UN Basic Principles on the Independence of the Judiciary and other international human rights standards. The study aims to identify strengths and weaknesses within the judicial system and to propose legal and institutional reforms that would enhance judicial independence, strengthen the rule of law, and improve the administration of justice in the Kurdistan Region of Iraq
